Terms & Conditions (for online bookings)

1.   Interpretation

In these Terms and Conditions the following expressions shall, unless otherwise specified or the context otherwise requires, have the following meanings:-

“Carer” means the person who attends a Class with the Child and who is responsible for looking after him/her;

“Child” means any child who has been duly registered and booked to attend a Class;

“Class” means a class run by Mini Athletics as more particularly described on the Mini Athletics’ Website;

“Competitor” means any person or entity which competes with Mini Athletics or offers classes similar to those offered by Mini Athletics;

“Fees” means the applicable membership fee and the price charged for attending a Class;

“Medical Condition” means any illness or injury for which, at the date the Child attends a Class or the date when the Parent books a Class for the Child (whichever is later), the answer to any of the Medical Screening Questions outlined at paragraphs 7.2 and 7.3 is ‘yes’ in respect of the child, plus any pre-existing, contagious or infectious illness or disease or other medical issue which affects a Child, Parent or Carer, including without limitation any behavioural disorder(s);

“Medical Screening Questions” means the questions outlined at paragraphs 7.2 and 7.3;

“Mini Athletics” means Mini Athletics Sports Academy, incorporated in the Emirate of Dubai under the laws of Dubai and the UAE, and any official associated franchisees;

“Parent” means a parent or legal guardian of a Child;

“Premises” means any premises where a Class is held and conducted;

“Terms and Conditions” means these terms and conditions as set forth by Mini Athletics and published on the Website (and which may be updated or varied by Mini Athletics, without notice, from time to time); and

“Website” means the website of Mini Athletics accessible from the following Uniform Resource Locator (URL): https://uae.miniathletics.com/

2.   Acceptance

2.1 These Terms and Conditions shall be deemed to be accepted by the Parent and the designated Carer (as the case may be) once they have ticked the box confirming their acceptance on the online booking form and completed payment of the applicable Fees.

3.   Fees, Payment & Booking Confirmation

3.1 All Fees must be paid in full at the time of completing a booking through the online booking form. No exceptions are permitted, and places cannot be reserved. A booking can be made for a block of either six (6) or twelve (12) Classes. Singular Class bookings are not permitted.

3.2 Upon completion of the online booking and confirmation of payment of the applicable Fees having been received in full by Mini Athletics, a booking confirmation shall be issued by email, which shall also act as the receipt.

3.3 The Classes paid for must be taken weekly in succession as they fall due.

4.   Refund & Cancellation

4.1  Mini Athletics has a general ‘no refund’ policy.

4.2  No refunds are given for non-attendance at a Class.

4.3  No make-up Class is offered for non-attendance at a Class.

4.4  If Mini Athletics cancels a Class then a make-up Class may be offered at its sole discretion, unless the cancellation was a result of an unexpected or unforeseeable situation, circumstance, or force majeure event. A make-up Class cannot be transferred to another block booking, nor can it be reimbursed if unused.

4.5  Any cancellation of a Class by Mini Athletics shall be intimated through appropriate communication channels as soon as reasonably practicable. In some cases, this may be at short notice due to factors or situations outwith the control of Mini Athletics. It is the responsibility of the Parent to ensure that they follow and stay up to date with Mini Athletics’ social media platforms for any such announcement(s) and ensure that their contact information is kept up to date and accurate at all times.

4.6  Mini Athletics shall have absolute discretion to cancel its contract with any Parent and/or Carer for any reason. Mini Athletics accepts no responsibility for loss or damage arising from such cancellation but will refund Fees for any Classes not taken as a result of Mini Athletics exercising its right to cancel the contract under this paragraph 4.6

4.7  A Parent may cancel a booking upon giving notice to that effect to Mini Athletics, however any Fees that have been paid are non-refundable.

5.   Obligations of Parents and Carers

5.1 The Parent warrants that the information provided on the online booking form is accurate and up to date at the time of booking and that it will notify Mini Athletics of any changes immediately.

5.2 The Parent or Carer must inform Mini Athletics of any Medical Condition affecting a Child before the Child participates in any Class.

5.3 Neither the Child, or his or her Parent or Carer, must attend a Mini Athletics Class when suffering from any Medical Condition without first notifying Mini Athletics and obtaining its consent to the Child participating in the Class.

5.4 The Parent and Carer shall have sole responsibility for the conduct and care of the Child during any class or whilst the Child is on the Premises.

5.5 The Parent or Carer shall not leave the Child unattended for any period of time whilst the Child is on the Premises.

5.6 Mini Athletics shall have absolute discretion to exclude a Child, Parent or Carer from any Class or Classes if, in the opinion of Mini Athletics, this is necessary to ensure the safety and wellbeing of other Children, Parents or Carers.

6.   Mini Athletics’ Policies

6.1 Photography

(a)  The use of any type of camera (including mobile phone cameras) and video recording equipment is strictly prohibited around any of the changing room areas located at the Premises. If a Parent or Carer is found to be taking photos or recording at a Class, then they will be asked to delete the images or footage immediately. This policy may also apply and be implemented on any part of the Premises or where the Class is taking place.

(b)  Mini Athletics may take photos or make a video of a Class for training feedback or marketing purposes only and a Parent shall be deemed to have consented to this by their acceptance of these Terms and Conditions. If, however, a Parent or Carer does not wish for their Child to be photographed or captured within video footage then they can opt-out of this and expressly remove their consent. 

6.2 Coaches

(a)  The Fees cover the services provided by coaches and are not attributable to individual coaches.

(b)  Mini Athletics aims for consistency and continuity with each Class. Every effort is made to ensure that the training schedule follows this aim, however occasionally a Class may need to be altered – such as a change to a Class size – as and when required.

(c)   Mini Athletics reserves the absolute right to change or substitute coaches at its absolute discretion.

6.3 Injury & treatment of injury

Any injuries that occur during a Class shall be reported to the Parent and/or Carer. Minor injuries shall be dealt with in line with the registered Medical Conditions submitted during registration by a qualified first aid responder. Parents and/or the Carer will be given the choice to remove their Child from a Class if they choose to do so based on the feedback from the first aider and the injury report.

For injuries that are classified as non-minor, Mini Athletics will issue an accident report form to the Parent confirming how the injury occurred and how it was treated (if applicable).

By completing an online booking or through participation in a Class, a Parent consents to Mini Athletics staff members and/or coaches with first aid qualifications being permitted to administer first aid to a Child.

6.4 Make-up Class

(a)  A make-up Class may only be offered in accordance with paragraph 4.4 at the sole discretion of Mini Athletics and will only be considered if Mini Athletics cancels a Class due to:-

                                                  i.     unexpected or unforeseeable circumstances, e.g. coach illness; unplanned Premises closure or repairs (without limitation);

                                                 ii.     national holidays being declared; or

                                               iii.     a force majeure event.

(b)  If a make-up Class is offered in accordance with paragraph 4.4 then Mini Athletics shall endeavour to offer a suitable make-up Class wherever possible, however availability shall be at the sole discretion of Mini Athletics and depends on various factors such as the availability of Classes and coaches and the coach to participant ratios.

A make-up Class shall not be offered for any other reason, including (but not limited to): family holidays; non-attendance at a Class; school timetables or conflicts with other activities.

6.4 Privacy Policy

(a)  Mini Athletics understands and respects the importance of a Parent and Child’s data and privacy.

(b)  Mini Athletics’ Privacy Policy is available and accessible through the Website. This may be updated and amended from time to time.

6.5 Communication Policy

(a)  Mini Athletics uses a variety of communication mediums to keep in touch with a Parent and Child. This includes email and social media platforms. Mini Athletics may utilise these platforms to send relevant news, information, updates and marketing content and material in relation to Mini Athletics’ activities. 

7.   Medical Screening

7.1 The Parent is required to disclose any Medical Conditions when the Child attends a Class or the date when the Parent books a Class for the Child (whichever is later). Mini Athletics considers an illness or injury to fall within the definition of a Medical Condition if the answer to any of the questions outlined under paragraphs 7.2 or 7.3 is ‘yes’ in respect of the child.

7.2 In the last 12 months, has the Child suffered from, received treatment or are receiving treatment or advice for:-

(a)  A heart or cardiovascular problem?

(b)  Diabetes, high blood pressure or high cholesterol?

(c)   Any form of cancer?

(d)  Any breathing condition (such as asthma or chronic obstructive pulmonary disease (COPD)?

(e)  Any gastrointestinal condition?

7.3 In the last 12 months has the Child had or been recommended to have:

(a)  Treatment or medication prescribed by a doctor, including repeat prescriptions, whether taking it or not?

(b)  Inpatient treatment or been aware of the need for inpatient treatment?

(c)   Investigation of a Medical Condition or awaiting a diagnosis?

7.3 If the answer to any of the Medical Screening Questions at is ‘yes’ in respect of the Child then the Parent is required to disclose all of the Child’s diagnosed health problems he/she is either suffering from at the present time or have received treatment or advice for in the last 12 months.

8.   Confidentiality

By agreeing to these Terms and Conditions, Parents and Carers agree that:

8.1 They will not share any aspect of the Mini Athletics programme with any Competitor of Mini Athletics;

8.2 They will not replicate or use any material provided by Mini Athletics or provide such material for the use of any third party; and

8.3 They are not and will not become involved with any Competitor of Mini Athletics.  

9.   Exclusion of Liability

9.1 Subject to paragraph 9.4 below, Mini Athletics does not accept responsibility under any circumstances for any loss suffered by the Parent, the Carer or by any other party arising either directly or indirectly from the Child’s participation in a Class or from any act or omission on the part of its coaching staff, whether or not such act or omission is negligent.

9.2 The Parent agrees, both on his/her own behalf and that of the Child, that any claim against Mini Athletics must be brought within 60 days of the event which gave rise to the claim. Any claim made thereafter will be time-barred.

9.3 The Parent agrees that the maximum liability Mini Athletics shall bear either to the Parent or to the Child for any breach of these Terms and Conditions shall not exceed the Fees.

9.4 Nothing in these Terms and Conditions shall restrict or exclude liability for death or personal injury caused by the negligence of Mini Athletics or by any of its coaching staff.

10.                Covid-19 (precautionary measures and standard operating procedure)

The following precautionary measures and operating procedures shall apply for so long as there is deemed to be covid-19 or coronavirus epidemic or pandemic:-

Online booking/registration:

·        Parents informed of relevant safety precautions at the time of completing an online booking and registering a Child.

Before each Class:

·        Mini Kits are to be purchased by parents for the free trials, to avoid equipment sharing. Mini Kits are available to purchase at the venue.

·        Social distancing to be maintained. Two-meter spaces to be maintained between participants/parents on arrival.

·        Mini Athletics staff at the entrance completing temperature checks.

·        Mini Athletics staff at the registration desk within the Premises completing the registers.

·        [Cones placed two-meter apart in a straight line in order to ensure social distancing while waiting.]

·        Masks may be required to be worn by all participants, parents, and staff.

·        Sanitization of equipment before use.

·        Temperate checks on arrival for all staff and participants – anyone with a temperate above 37.5c will not be allowed entry.

·        Signage on arrival and surrounding the activity hall in line with government guidelines.

·        Participants are encouraged to bring their own water and sanitizer.

·        [Sanitizer will also be provided at the venues].

·        [4 cones two-meter apart for water breaks].

·        Coaching equipment to be kept a minimum of two-meter away from all spectators and participants.

During:

·       Social distancing to be maintained. Two-meter spaces between participants/parents during the session.

·       Children requested to arrive on the pitch at the time of the session to avoid waiting time.

·       A maximum of [4] participants per section.

·       Masks may be required to be worn by all participants, parents, and staff.

After:

·       Social distancing to be maintained. Two-meter spaces between participants/parents on exit.

·       Masks may be required to be worn by all participants, parents, and staff.

·       Sanitization of equipment after use.

11.                General

11.1 By agreeing to these Terms and Conditions, the Parent consents to the processing and use of personal data relating to the Child and the Parent by Mini Athletics.

11.2 The parent shall indemnify Mini Athletics for all losses sustained as a consequence of any act or omission on the part of a Child, Parent or Carer.

11.3 Any notices to be sent to any party to this contract shall be sent by pre-paid recorded delivery or hand-delivered and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.

11.4 Any failure by a party to the contract governed by these Terms and Conditions to enforce for any period of time rights arising under the contract shall not operate as a waiver of those rights.

11.5 Mini Athletics reserves the right to update, amend or vary these Terms & Conditions, without notice, from time to time.

11.6 Any dispute or claim arising out of or in connection with these Terms and Conditions shall be governed and construed in accordance with the laws of the Emirate of Dubai. The parties irrevocably agree that the courts of Dubai shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions.
